The accused faces up to 15 years in prison if convicted

María Paz Peñaloza Cabrera, a 31-year-old mom to two young sons, died after a butt implant removal procedure on March 28.

Her family never got to say goodbye as her parents and eldest son were unable to travel from Colombia, her family said on a GoFundMe.

Peñaloza Cabrera's heartbroken mom showed up to court on Monday as devastating details of her daughter's death were discussed.

She called Peñaloza Cabrera's doctor, Felipe Hoyos Foronda, 37, “an assassin,” insisting, "He’s a danger to society."

Her fury comes after a court heard how Peñaloza Cabrera had gone to Foronda on March 28 to have silicone implants removed at his Queens apartment in New York City.

The mom was accompanied by a friend who waited in the living room while she went into an adjacent room for the procedure.

Foronda is alleged to have given Peñaloza Cabrera lidocaine, a local anesthetic, and saline through a syringe.

She quickly became lightheaded, causing Foronda to administer an IV. He called 911 when she did not improve.

The mom was unconscious on a medical chair by the time paramedics arrived at the apartment, which prosecutors called a "makeshift clinic."

Peñaloza Cabrera was taken to Mount Sinai Queens, where she showed no sign of brain activity. She was removed from life support on April 11.

"On March 28, the victim went into cardiac arrest after having been injected with lidocaine [anesthetic] as part of a botched surgical procedure," Queens District Attorney Melinda Katz said.

"Unfortunately, Maria Penaloza, a mother of two, passed away two weeks later.

"My thoughts are with the victim’s family as we seek justice on her behalf.”

She announced this week that Foronda was indicted by a grand jury on charges of manslaughter and assault.

He was also indicted for the unauthorized practice of a profession for allegedly performing cosmetic surgery without a license in his Astoria home.

The $1,900 procedure was being carried out in his living room, according to the indictment.

SICK ADMISSIONS

Foronda was arrested at JFK airport in New York hours after his patient was rushed to the hospital.

The district attorney said he booked a flight to Florida and was planning to flee to Colombia, “so he could evade arrest and prosecution because he claimed he was scared."

When Forondo was brought in for questioning, he allegedly told cops, "I injected her in the ass."

Peñaloza Cabrera then started slurring her words and lost consciousness, the court was told.

“After I injected her, she started to speak funny, then she stopped speaking, and then she tensed up,” Foronda told police.

He added that “slurred speech is normal during this type of anesthesia, even though, after she tightened up, she didn’t respond.”

Foronda then began to panic, prosecutors said.

The court heard how the ambulance crew took the mom to hospital as Foronda hurriedly cleaned the room before heading to the airport.

After his arrest, Foronda allegedly insisted he'd done the procedure that led to Penaloza’s death “hundreds of times.

“Word of mouth has given me my business,” he told cops, according to The New York Post.

“I’ve been practicing in that apartment for a few months ... I’m not a licensed doctor here. I understand that I’m not allowed to practice medicine.”

"Hoyos Foronda, who does not have a license to practice medicine in the United States, was apprehended at John F. Kennedy International Airport by a Port Authority police officer as he attempted to board a flight to Florida with an ultimate destination of Colombia," the DA wrote.

If convicted, Foronda faces up to five to 15 years in prison. He's been ordered to return to court on June 3.

DA Katz said anyone who used the defendant’s services or visited the makeshift medical office on 35th Street in Astoria should contact NYPD’s Crime Stoppers Hotline.

"A court-authorized search warrant of the defendant’s home found medical equipment including a metal IV stand, multiple injectables on the shelves, syringes, a box to discard needles, and a binder with the names of individuals."

"Anyone seeking medical or cosmetic treatments is urged to first check the credentials of the provider with the New York State Education Department Office of the Professions," she added.
