Settlement reached in case involving 11-year-old boy’s death at Iowa theme park
The former owners of Iowa's Adventureland Park have settled with the family of an 11-year-old boy who died on a ride at the theme park.
Michael Jaramillo, 11, of Marion, Iowa, died in 2021 when the raft he was in on the Raging River ride overturned, trapping him under the water. His 15-year-old brother spent weeks in a medically induced coma and survived.
David Jaramillo Sr., Michael's father, reflected on his son's death in 2022, saying, "I'm very blessed to have my son for 11 years. He belongs to God first. So, he just went back to where he came from."
Jaramillo's family was suing the former owners of Adventureland, accusing them of not training workers and making unauthorized modifications to the waterways and rafts on the ride.
The Raging River was inspected each year it was in operation, including the day before the incident, where it passed with "satisfactory" marks.
Jury selection in the trial was set to start Monday.
Fred Dorr, the Jaramillo family's attorney, described the harrowing experience from a father's perspective, stating, "I'm a father and a horrific standpoint from a father's perspective is his last view of one of his two sons. They were underwater from their waist to their head, so they were upside down, strapped in, and one of the boys was reaching for his father. And so he will live with that for the rest of his life."
Dorr had prepared expert testimony to argue that the 1,700-pound raft was faulty and that Adventureland failed to ensure the ride operator could see the raft throughout its run. He said the former owners, including former CEO Mike Krantz, agreed to settle with the Jaramillo family one day before the trial was to begin.
"The reality of what might happen to them, at trial, puts a massive amount of pressure on them. And they finally decide we're going to try and resolve this thing," Dorr said.
Dorr emphasized that the Jaramillo family believes the money is not important, stating, "There's no amount of money for the loss of a child, especially like happened in this case. A lot of those things that people assume are safe when you really get down to it, maybe they aren't."
An attorney for the Jaramillo family released the following statement:
"Almost four years after the family tragedy, on the eve of trial in Polk County, the Jaramillo family reached a confidential settlement with Defendants Adventure Lands of America, Inc. and its CEO, Michael Krantz. While this portion of their journey is over, it will never bring back their child, Michael Jaramillo. The facts learned over the course of this litigation raise serious concerns regarding the safety and oversight of the amusement park industry as a whole. The Jaramillo family hopes that the industry takes note of this horrifying incident and substantive changes occur to increase the safety of amusement rides both in Iowa and throughout the nation."
The settlement amount remains confidential. Attempts to reach the attorney for former Adventureland CEO Mike Krantz have been unsuccessful. The current owners of Adventureland are not involved in the lawsuit.
